A federal appeals court has temporarily paused a lower judge’s order for former President Donald Trump’s January 6 records from being handed over to a congressional committee investigating the deadly Capitol riot.
The House select committee was set to receive the first batch of records from January 6 on Friday. But Trump’s lawyers filed papers in the appeals court on Thursday requesting a temporary delay as they pursue an expedited appeal.
Late Thursday, the US Court of Appeals in the District of Columbia granted ‘an administrative injunction’ to Trump. The three-judge panel set November 30 for arguments in the case.
‘The purpose of this administrative injunction is to protect the court’s jurisdiction to address appellant’s claims of executive privilege and should not be construed in any way as a ruling on the merits,’ the judges wrote on Thursday.
The judges – Ketanji Brown Jackson, Patricia Millett and Robert Wilkins – were all appointed by Democratic presidents. President Joe Biden appointed Jackson, and Millett and Wilkins were appointed by former President Barack Obama.
Thursday’s decision represents a temporary victory for Trump, who has tried to claim executive privilege to keep the records off the hands of lawmakers on the committee.
