Ivanka Trump dismissed from fraud lawsuit as court narrows case against Trumps

President Donald Trump’s eldest daughter Ivanka Trump has been dismissed from a civil fraud case against her family and their real estate company.

A New York appeals court on Tuesday rejected ex-President Trump’s bid to have state Attorney General Letitia James’ $250million suit against him, his three elderly children and the Trump Organization tossed.

However, the court dismissed Ivanka as a defendant and narrowed the case. That potentially limits the case against Donald, Donald Trump Jr, Eric Trump and their company.

James’ suit alleges that the Trumps and their organization inflated their asset valuations to obtain tax breaks and favorable loans.

The Appellate Division of the State Supreme Court in Manhattan ruled 5-0 that James’ claims against Ivanka be dismissed because the attorney general missed a deadline to file against her. Ivanka was no longer employed with the Trump Organization after 2016, states the ruling.

State law allows James to investigate ‘repeated or persistent fraud or illegality’, the appeals court ruled. But the court said that statues of limitations bar James from suing over claims before July 13, 2014, or before February 6, 2016, depending on the defendant.

The appeals court returned the case to state Supreme Court Justice Arthur Engoron to decide if claims against the ex-president, the Trump Organization and Trump Jr and Eric, who serve as its executive vice presidents, should be limited.

A trial for the case is slated to start on October 2.

‘There is a mountain of evidence that shows Mr Trump and the Trump Organization falsely and fraudulently valued multiple assets and misrepresented those values to financial institutions for significant economic gain,’ stated a spokeswoman for James.

‘This decision allows us to hold him accountable for that fraud, and we intend to do so.’

Attorneys for the Trumps did not immediately comment on the development.

Ex-President Trump sat for a deposition in the case in mid-April.

‘He remains resolute in his stance that he has nothing to conceal,’ said his lawyer Alina Habba ahead of the hearing that day, ‘And he looks forward to educating the Attorney General about the immense success of his multi-billion dollar company.’
